Terms and Conditions

Format of the Contract

These terms of sale apply to all goods supplied by M/S HUBTUB, whose registered office is at HUBTUB, P-17, Oxy Town, Kolkata, 700061 (the "Supplier", “Our”).

No contract exists between you and HUBTUB for the purchase of any goods until your order has been accepted and full payment has been received in cleared funds. Upon confirmation of payment and issuance of an acceptance email, a legally binding contract is formed, and it will be governed by these Terms and Conditions.

Order acknowledgment via email is not confirmation of acceptance. Acceptance occurs only after successful payment processing and confirmation.

The contract is subject to your right of cancellation.

The Supplier may change these terms without notice for future sales.

Description and Price of the Goods

  1. The description and price of goods will be as displayed on our quotation while you place your order.
  2. All products are subject to availability. If an item is out of stock, HUBTUB will notify you promptly and offer an alternative, or issue a refund or credit for any amount paid.
  3. While we aim to ensure pricing accuracy at all times, if an error is found, you’ll be informed and given the choice to confirm the order at the corrected price or cancel it. If we don’t hear from you within 7 days, the order will be automatically cancelled and any payment refunded.
  4. Delivery charges may apply and will be added to the purchase order.

Payment

  1. Payment must be made in full, through any of the accepted methods proviced in the order confirmation mail, before your order is dispatched.
  2. Orders will not be shipped until full cleared payment is received.
  3. For B2C orders, 50% advance payment is applicable within 1 hour for order confirmation.
  4. For larger orders and B2B orders payment should be cleared by 48hours.
  5. You agree to make payment in full without any deductions unless authorized by a valid court order.

Risk/Title

  1. Risk passes to you upon delivery.
  2. However, ownership of the goods remains with HUBTUB until full payment is received.
  3. HUBTUB reserve the right to recover goods or seek payment, even if ownership hasn’t yet transferred.

Title for Business Customers

  1. If you’re purchasing as a business customer:
    1. Goods must be stored separately and clearly marked as HUBTUB property.
    2. You must not deface or remove any labeling.
    3. Maintain the goods in satisfactory condition and insure them for their full value until title passes.
    4. Insurance proceeds must be held in trust for HUBTUB.
  2. Your rights to possess the goods terminate immediately if:
    1. You are subject to insolvency proceedings, liquidation, or administration.
    2. You are unable to pay your debts or are subject to enforcement action.

Warranty

  1. All products sold by HUBTUB are covered exclusively under their respective Original Equipment Manufacturer (OEM) warranties. The warranty terms, duration, and support process are governed directly by the OEM and may vary between products.
  2. HUBTUB acts as a facilitator and does not provide in-house warranty coverage for any hardware or components unless there is a premium service opted or AMC has been opted. Customers must contact the respective manufacturer for warranty support, claims, and replacements. HUBTUB will assist in directing you to the appropriate OEM support channel upon request.
    1. OEM warranty durations and terms are subject to the manufacturer’s policies.
    2. Physical damage, improper installation, unauthorized modifications, or use outside the intended purpose may void the OEM warranty.

HUBTUB Service Options

  1. To enhance your experience, HUBTUB offers optional support services:

    1. Assistance with warranty claim direction (OEM support guidance).
    2. Product installation help (remotely, where applicable).
    3. Initial setup support via email or call (up to 7 days after delivery).
    4. Basic system troubleshooting support (Remote, non-hardware related) upto 1 year.
  3. Note: HUBTUB Basic Service does not include physical servicing, pick-up/drop, or on-site support.
  4. HUBTUB Premium Service (Optional – Paid Upgrade)

    1. Priority support via phone, WhatsApp, or email.
    2. Remote installation and configuration assistance.
    3. End-to-end coordination for OEM warranty claims (pickup/drop facilitation where applicable).
    4. One-time on-site visit within warranty period (within serviceable areas).
    5. Extended setup support (up to 30 days from delivery).
    6. Software & performance optimization (1 session per year).

Paid Annual Maintenance Contract (AMC) for businesses

  1. For businesses or users seeking regular upkeep, HUBTUB offers paid AMCs tailored to your setup.

      AMC Includes:

    1. Scheduled preventive maintenance visits (quarterly/bi-annually).
    2. System health checks and performance tuning.
    3. OS & software update assistance.
    4. Priority support access.
    5. Discounts on paid services and upgrades.
  3. AMC packages are customizable based on system count, configuration, and location.

HUBTUB Virtual IT Department (Enterprise-Class IT as a Service)

  1. The HUBTUB Virtual IT Department is a comprehensive solution for businesses and professionals seeking end-to-end tech support without the cost of an in-house IT team.
    1. What It Includes:

    2. Annual Maintenance Contract (AMC): Complete care for all IT infrastructure.
    3. Quick Assistance: On-demand virtual/remote tech support for day-to-day issues.
    4. Dedicated Support Manager: A single point of contact for all your IT needs.
    5. IT Consultation: Infrastructure scaling, software licensing, hardware upgrade strategy.
    6. Critical Solution Support: Rapid response for system failure, data loss, or network issues.

Limitation of Liability

  1. If you're a consumer, HUBTUB will not be liable for:
    1. Losses where there’s no breach of legal duty.
    2. Losses not reasonably foreseeable.
    3. Losses resulting from your breach of contract.
  2. HUBTUB is not liable for indirect or consequential losses for business customers (e.g. lost profits or downtime).
  3. Nothing in these terms excludes liability for death, personal injury due to our negligence, or fraud.

Data Protection

We take appropriate measures to protect your personal and payment information. However, we’re not liable for unauthorized access unless due to our negligence.

Promotions

  1. Promotional offers are valid only during specified periods and while stocks last.
  2. Free items during promotions are non-refundable, non-replaceable, and come with no warranty.
  3. HUBTUB reserves the right to change or cancel promotions without notice.
  4. HUBTUB is not responsible for technical issues or incorrect contact information that may prevent participation in promotions.
  5. We are not obligated to provide promotional codes (e.g. AMD Key Codes) after the promo ends or if stock is exhausted.
